As a general practice, should the top of my foundation membrane be sealed at the top against the foundation? As you can see from the picture, i have a burried downspout extension nearly at level with the top of the membrane and is a vulnerable spot for water intrusion. What should be done as a preventative measure?

Depends on the product used. Dimpled products allow a gap for easy drainage to the drain tile at the footing but membrane types keep moisture off the concrete completely. I really can't tell for sure what you have?
